Kevin O'Leary and his wife Linda are facing a lawsuit from the family of Susanne Brito, one of the people who was killed in a boat crash involving the Shark Tank host. Although O'Leary alleged that his wife was driving the boat at the time, the lawsuit now claims that alcohol and/or drugs played a part in the Kevin O'Leary boat crash.

According to TMZ, the lawsuit does not explicitly mention who was driving the boat at the point of impact. It does, however, state that both Kevin and Linda should have been more aware of their surroundings and how fast they were going.

The lawsuit also alleges that neither Kevin nor Linda were wearing prescription glasses that they would have been required to wear while operating their boat, particularly at night, when the crash occurred.

Both Susanne Brito, 48, and Gary Poltash, 64, were killed in the boat crash that took place on August 24 at around 11:30 p.m.

Linda O'Leary was charged with careless operation of a vessel, which is not a criminal offence, but did result in a $10,000 fine. The driver of the second boat was also cited for operating the boat at night without proper navigation lights.

The wrongful death lawsuit filed by the family of Susanne Brito is asking for $2 million in total: $1 million for compensatory damages, and $1 million for punitive damages. The family is also seeking payment from the driver and owner of the boat that Brito was on.

The lawsuit claims that Kevin and Linda O'Leary "behaved with arrogance, high-handedness and have shown a callous disregard and complete lack of care," according to TMZ.

"For this grieving family, it is about obtaining civil justice so as to prevent these types of deaths and curtailing reckless and dangerous behaviour from continuing on our lakes," said Patrick Brown, the lawyer representing Brito's family, according to CTV News.

Kevin O'Leary had previously run for leadership of the Conservative party of Canada. However, he dropped out of the race.
